Governing Law: These Terms are governed by the laws of the State of California, without regard to its conflicts of law principles. Exclusive jurisdiction shall be in the state and federal courts located in Los Angeles County, California.
Severability: If any provision is deemed invalid, the remaining provisions will continue in full force and effect.
No Waiver: PasmoUSA’s failure to enforce any provision shall not constitute a waiver of that provision.
Time Limit: Any claim arising from use of the Site must be filed within one (1) year of the claim’s accrual or be barred.
Headings: Section titles are for convenience only and have no legal effect.

13. PASMO Additional Terms and Conditions

Shipping & Delivery
PasmoUSA ships only within the continental United States. Risk of loss and title pass to you upon delivery of the product to the carrier. You are responsible for filing any carrier claims for damage or loss.

Damaged Shipments
If your order arrives damaged, you must file a claim with the carrier within 48 hours of receipt and provide photographic evidence. PasmoUSA will assist but is not responsible for refunds or replacements until the carrier resolves the claim. All damage must be noted on the delivery receipt at the time of delivery.

Missing Shipments
Missing shipments must be reported within 72 hours of the expected delivery. PasmoUSA will initiate a trace or claim with the carrier. If the shipment cannot be recovered, PasmoUSA may issue a replacement or refund at its discretion.

Equipment Purchases
All equipment sales are governed by the PasmoUSA Sales Agreement, which includes warranty, maintenance, and return terms. In the event of any conflict, the Sales Agreement controls. Contact PasmoUSA for a copy of this agreement.
